These Terms of Use ("Terms") govern access to and use of YOPO, an online planning and organisation service for teachers ("YOPO", the "Service").

YOPO is currently operated by a natural person and is offered directly to individual teachers. YOPO is not currently operated as an institutional solution contracted with schools or educational authorities.
By creating a YOPO account or using the Service, you agree to these Terms.
YOPO is intended for persons aged 18 or over.
The Service is primarily intended for teachers and other professionals who wish to organise their professional activities using a digital planning and agenda tool.
You are responsible for ensuring that your use of YOPO complies with the laws and professional rules applicable to you.
Certain YOPO features require you to create an account.
You must provide accurate information when creating your account and keep your account information up to date.
You are responsible for maintaining the confidentiality of your password and for activities carried out through your account.
Passwords are stored using a secure one-way password hashing mechanism. YOPO does not store your password in plain text.
You must notify YOPO if you become aware of unauthorised access to your account.
YOPO may take reasonable security measures, including invalidating existing sessions following a password change, in order to protect accounts and data.
YOPO provides tools that may allow you to manage timetables, lessons, events, pupil information, attendance, lateness, evaluations, observations, documents, photographs and other information relevant to your work.
The information fields concerning pupils are optional. You are not required to enter a pupil's first name, last name, date of birth, attendance information, lateness, evaluations, observations or other information.
Where appropriate, you may use pseudonyms, initials or other identifiers instead of directly identifying a pupil.
You must only enter information that you are authorised and legally entitled to process.
You remain responsible for determining whether and why particular information should be recorded in YOPO in the context of your professional activities.
YOPO is not intended to be used to store special categories of personal data within the meaning of applicable data-protection legislation.
You must not enter or upload special-category personal data concerning pupils or other individuals, including information concerning:
This prohibition applies both to structured fields and to free-text observations, as well as to uploaded photographs, documents and other files.
If you become aware that prohibited information has been entered or uploaded, you should remove it promptly and contact YOPO where appropriate.
YOPO may offer paid subscriptions and free trial periods.
The applicable price and subscription conditions are presented to you before purchase.
Payments are processed through Stripe. YOPO does not store your complete payment-card details.
Subscription-related information may be communicated to YOPO through secure technical notifications (webhooks) from the payment provider in order to activate, maintain or terminate the corresponding subscription.
Unless mandatory applicable law provides otherwise, cancellation of a subscription does not automatically entitle you to a refund for a period already paid for.
Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded or restricted.
YOPO may offer a trial period.
If a trial account remains inactive and is not converted into a paid subscription, YOPO may retain the associated data for up to three months before deleting the account and its associated production data.
When a paid subscription expires, the associated account and production data may likewise be retained for up to three months before deletion.
You may request deletion of your account at any time.
Following account deletion, the corresponding production data are deleted. Copies may temporarily remain in encrypted backup systems for the normal backup-retention period, which is a maximum of 14 days.
You retain responsibility for the information, documents, photographs and other content that you enter or upload to YOPO ("User Content").
You grant YOPO only the rights necessary to store, process, transmit and display User Content for the purpose of providing the Service requested by you.
YOPO does not acquire ownership of your User Content.
YOPO does not use pupil information for advertising, sale, profiling or unrelated commercial purposes.
YOPO processes personal data in accordance with applicable data-protection legislation, including the General Data Protection Regulation (GDPR) where applicable.
Because YOPO is a technical service used by individual teachers, the responsibilities of YOPO and the teacher may differ depending on the processing activity.
YOPO determines the purposes and essential technical means necessary to operate, secure and provide the YOPO platform. The teacher determines, within their professional context, what pupil information they choose to record and the professional reasons for doing so.
Nothing in these Terms is intended to transfer to the teacher responsibilities that legally belong to YOPO, or vice versa.

YOPO aims to provide a reliable service but does not guarantee uninterrupted or error-free availability.
YOPO performs regular backups of production data.
Backup data are encrypted before being transmitted to and stored on separate infrastructure located in Falkenstein, Germany. The backup storage is not publicly accessible from the Internet and access is restricted through the Hetzner network and SSH keys.
Backups are retained for a maximum of 14 days.
Backups are intended to support recovery from technical incidents. They do not constitute an unlimited or permanent archive of User Content.
YOPO, including its software, design, interface, branding, logos, text, functionality and other original elements, is protected by applicable intellectual-property laws.
Except where expressly permitted, you may not copy, modify, distribute, reverse engineer, reproduce or commercially exploit YOPO or its underlying software.
These Terms do not grant you ownership of YOPO or its intellectual property.
You must not use YOPO to:
You must not attempt to discover, exploit or bypass security vulnerabilities in YOPO.
If you discover a security vulnerability, please report it to contact@yopo.lu rather than exploiting it.
YOPO may suspend or terminate an account where reasonably necessary to:
Where reasonably possible, YOPO will take appropriate steps to inform the user before termination or suspension, unless immediate action is necessary for security, legal or operational reasons.
Account termination does not remove any legal rights or obligations that arose before termination.
YOPO is provided with the aim of supporting teachers in organising their professional activities.
YOPO does not replace the professional judgement, legal obligations or institutional procedures applicable to the user.
YOPO cannot guarantee that the Service will always be available, completely error-free or immune from all security incidents.
To the extent permitted by applicable law, YOPO is not responsible for losses resulting from:
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
YOPO may modify or improve the Service over time.
YOPO may also update these Terms where necessary, including to reflect changes to the Service, legal requirements or security practices.
Material changes will be communicated through appropriate means where reasonably necessary.
The updated version will indicate its effective date.
These Terms are governed by the laws of Luxembourg, subject to any mandatory provisions of law that may apply to you.
Any dispute shall be subject to the jurisdiction of the competent courts of Luxembourg, without prejudice to any mandatory rights concerning jurisdiction or consumer protection.
